CALL TO ORDER:
The meeting was called to order by Board
President Dave Morley at 10:05 am in the County Services Building in
Bear Valley, California and via telephone conference bridge for those
members unable to attend in person.
* Minutes of 7/8/10 Board
Meeting

to approve the minutes of the 7/8/10 special board meeting
report.

* President's Report
DishNet programming defaults to Sacramento and it's a difficult
political (FCC) issue to get the regional coverage changed for Bear
Valley. When they look at our zip code and county they have to default
to Reno per the FCC. This is a safety issue for those in Bear
returning to the Bay Area who are unable to see the appropriate
regional weather and forest fire information.
MOTION: Paul Petersen made a motion for Dave Morley to write a
letter to Dan Lundgren (s/b Lungren) regarding this FCC issue that
needs to be corrected so BV can be properly serviced with Sacramento
stations. The letter is not intended to impact BV residents who
receive Bay Area station coverage from Direct TV.

* Bylaws Update
The committee, Ron Rossi, Sue Garratt and
Dave Morley met. Ron provided an update.
Consulted Kurt
(s/b Curt) Sproul for a more modern
example of bylaws for us to refer to with the idea that we can redraft
our bylaws according to more modern standards.
Discussion of possible alternatives for
submission of election ballots. Two alternatives. One the way it is
handled now with ballot and check included in one envelope. Or the
double envelope approach: Outside envelope includes the check. Inside
envelope has the ballot. This way the audit can be done that the check
is present without sacrificing anonymity of the ballot.
Discussion of bylaws wording around names
being included on the ballot. Decision to discuss in greater
detail when draft by-laws are circulated.
Board nomination process. Jack Wedgwood
will continue as nominating chair.
Five members (Dave, Jeff, Eric, Ron, Sue)
are up for renewal this year.
Discussion of a published list of Bear
Valley homeowner information.
Discussion of the creation of a list for
the community, internal to the community.
Randy Mancini/Ann Porteus will look into
the technical aspects of this such as a password protected log in off
our Website and having people be able to opt into/out of pieces of
information to share
Discussion about how many from a single
household may be on the board and how many votes per household at
board meetings.
* BV Water District
Report
Update from Barbara Goodrich.
The process is moving along in a
thoughtful, measured way. Since BVWD GM Julio Guerra spoke to
the BVRI general meeting on 9/5, District Engineer Gary Ghio finalized
his capacity report which is under review by BVWD's Technical Advisory
Committee. Action is expected on the report at the District's
meeting 10/18/10. Meanwhile, BVWD GM Julio Guerra is meeting
with Development partner Chuck Toeniskoetter on Weds., 10/6/10.
Barbara addressed the Union Democrat's recent article.
The BVRI board offered to assist if we can
and we are standing by.
The board thanked Barbara for her diligent
attention to this issue.
* LAWC Report
Algae bloom discussion. An email blast went
out this week about the bloom. The LAWC is following the
issue.
* Transportation presentation at CSA
Meeting
Alpine County Director of Public Works
Brian Peters made a presentation on long range financial planning for
county roads at the CSA meeting on September 15. County revenues,
especially timber receipts, are declining and we need to start
planning for the future. There is a link to the presentation on the
BVRI website at:
http://www.bvri.org Eric Jung indicated that
the solution was expected to involve many facets, but the
"low-hanging fruit" was probably the $3,000,000 South Tahoe
PUD fund. At the CSA presentation, ski mountain CEO Martin
Wegenstein rejected the idea of a $1/lift ticket surcharge for the
road fund which had the advantage of keeping the money local but
didn't provide a direct linkage between the payers and the
beneficiaries of the surcharge.
Dave Morley will ask Brian Peters to come
to a BVRI board meetings for questions in December or July. (NB: We
have six miles of county road in BV and 120 miles of county road on
the East side of the county.)
* Large home size
No new report at this time.
* ARC Report
Nothing major for new homes at this time.
Some requests in for minor changes, painting, etc.
* Beach Update
The beach is officially closed as of
10/3/10. Porta-johns and garbage cans are being removed. There are
still quite a few boats that boats on the beach that may compromise
winter drainage and need to be removed from the beach by October 17.
After that date they will be considered abandoned property and will be
confiscated/removed.
The beach has been posted no-swimming
related to the possible toxicity of the algae bloom. Discussion of
BVRI supporting the LAWC to resolve the algae problem (even animals
drinking from it are at risk).
Discussion regarding road to the small
beach that is mostly owned by the resident in the log cabin by the
small beach. Residents need to be aware when we are doing anything to
that area. Owners are fine for now using their property as
access to the small beach. Someone raised the possibility that
there may be documents showing BVRI has control of the access to the
beach.
* Newsletter: Jeff
Next newsletter to go out end of
October.
Jeff will be collecting and drafting
articles.
* Bear Update
There have been no break-ins since the one
400-lb bear was struck and killed by a car several weeks ago. There is
evidence that a smaller bear was breaking in, but there have been no
break-ins since the larger bear was killed. The trap has been
removed.
* Chipper Program
There was a delay in getting country
funding to run the program that has been resolved and the chipper will
be chipping in the next week.
* Fire Safety
Inspections are complete. Violator letters
went out. Most violations are related to low and low hanging branches
on trees. Discussion that homeowners in BV need to be reminded
to post their house numbers high enough so they can be seen in middle
of winter in case of fire or emergency needs
* Report from the Board of
Supervisors
No report at this time.
* New Business
Member John Dralla said he reviewed his Alpine County property
tax bill and noted that the fire assessment for his property increased
by an inflation factor plus approx. $150, presumably from the March
vote re medical services. John commented that this amount was
higher than he expected and wondered what other people had on their
property tax bills.
* Closed Session
Two letters have been sent to a homeowner
with a snow mobile clearly visible and covered by a blue tarp.
Discussion of how to handle this CC&R violation.
