MINUTES BVRI BOARD MEETING JANUARY 18, 2003

ABSENT BOARD MEMBERS: Don Thorson Paul Peterson Jim Blake Sue Garratt Guests: John Caldwell David Fajen Rosemary Fajen Jeff Millar Greg Peterson Rick Stephans Terry Woodrow CALL TO ORDER: The meeting was called to order by President Dave Morley at 4:02pm in a joint presence at the Community Services Building Conference Room at Bear Valley, California and on a conference call-in number set up to accommodate members unable to attend this meeting in person.
GUEST PRESENTATION CDF and US Forest Service represented a number of suggestions based on opinions and resources available about fire safety in Bear Valley. Bear Valley is delegated to forest service for fire prevention. Because of this, an aggressive homeowner structure defense program is crucial. In addition, timber harvesting on common areas needs to be done to reduce fuel load. Forest service property should also be harvested to remove overstock. John Caldwell, Fire Prevention Officer in Calaveras County reported on: 1. Enforcement of state law that requires clearance of all burnable materials around all structures. Clearance is: 30 ft around structure plus branches hanging over structures must be cleared. Chimneys: Must be screened Propane tank and outbuilding clearance: Ten feet If a dangerous situation is identified (dead/dying trees or live trees that are overstocked) it can be called out to the Forest Service District Office in Hathaway Pines. Five years before cutting can occur, the Forest Service has to complete an Environmental Impact Statement, Formulate a Plan, and get Input from local environmental groups, among other things. First step for the enforcement program: Send a mailer in May/June to advise of law and outline responsibility of homeowners. Second step: The following year they would do a 50% compliance check. Those who are compliant get a letter thanking them. Those who are not in compliance get a letter indicating they have thirty days to become compliant. Forest service can do inspections and they also train local community members and local fire department to do inspections. By the third year they look for 100% compliance. 2. Community Fire Safe Council Organization Locally focused. Grant funded. Grants are available to support fire safety efforts. There are a total of four councils formed so far. Our local council is called: Sierra Highway 4 Fire Safe Council Meetings are on the first Weds of every month at 6pm. Next meeting (2/5/03) will be at Fire Dept in Angel's Camp on Highway 4. Considering meeting in BV, but weather is prohibitive except in the summer. Terry Woodrow attends representing Bear Valley.
* Minutes of October 12, 2002 Meeting MOTION: Bill Webb Moved to approve the minutes of the 10/12/02 BVRI Board Meeting as distributed by Katherine Aitken-Young SECOND: Brian Neth Seconded All members in favor. None opposed. Katherine Aitken-Young will send a final set of minutes to Eric. Eric Jung will post the approved minutes to the website.
* Treasurer's Report Report was distributed and reviewed by Brian Neth. - Our cash on-hand is less than last year at this time. - With such expenses as the new swimming raft, we are now spending more than we collect in revenues - A financial plan will be developed by Brian Neth, Bill Webb, and Sue Garratt additional funds are needed to support planned activities. - In the next newsletter we'll ask again for email addresses so we can reduce printing and mailing costs. MOTION: Eric Jung moved to accept the treasurer's report. SECOND: Gary Willard Seconded All members in favor. None opposed.
* Resignation Terry Woodrow resigned her board position. MOTION: Nominating committee chair, Jack Wedgwood, nominated Ron Murphy to complete Terry's term that ends in 2004. SECOND: Eric seconded the nomination All members in favor. None opposed.
* President's Report Dave Morley met with Sheriff Rick Stephans to open discussion on snowmobile use and law enforcement. The radar reports indicate there are a high percentage of snowmobiles traveling at 20MPH. A few are traveling at higher speeds. Noise limit of 82db is max allowable per state law. Sheriff's office doesn't own a db recorder--but are exploring a source for one. MOTION: Eric Jung moved to allocate no more than $500 to purchase a sound meter for the Sheriff's office to use. SECONDED: Leslie Peterson seconded. All members in favor. None opposed.
* Nomination Committee Report Jack Wedgwood reported that he has not completed the nominations and will do so by email in the next week. Terms expiring: Katherine Aitken-Young Sue Garratt Brian Neth Paul Peterson Bill Webb * Compliance Committee Report A fine schedule for non-compliance issues is being developed and will be published in the newsletter. The fine schedule will cover such things as: Unauthorized tree removal Improvement to exterior of the home without prior ARC approval Boat and trailer storage Unauthorized lighting or incorrectly aligned lighting Garbage and storage of old appliances and other large items * ARC Report Two actions underway: Approval of new home on upper Schimke and new home halfway around Schimke. Expect approval in three to four weeks.
* 5:35 pm CC&R Compliance Violation Hearing Regarding: Roof Color Violation ARC Chair Ron Murphy presented history and actions. The building contactor received ARC approval for two different roof colors from two different manufacturers--neither of which was the one that was applied to the actual roof. The actual roof was a very bright green that would not have been approved according to Ron Murphy. The homeowner indicated that the building contractor had explicitly assured him he did not have to re-submit the new roof to the ARC for approval--that it was already approved and there was no need. The homeowner provided a copy of a letter written by the building contractor (that was not yet received by BVRI) indicating the roof color was one of the approved names--Forest Green--but it came from a different manufacturer than that submitted for approval. The building contractors indicated in his letter that he assumed approval due to the similarity in the name of the color--even though it was a lighter green than was submitted for approval.
* 5:55 pm Executive Session Commenced Regarding: Roof Color Violation To preserve the integrity of the CC&Rs, an action must be taken. Dave Morley will consult with BVRI lawyer Curt Sproul as to what that action ought to be.
